General Terms and Conditions

1. All orders accepted and all goods supplied by Helbling shall be subject to our terms and conditions. The purchaser's acceptance of products shipped by Helbling constitutes acceptance of our terms and conditions including our reservation of title to the goods pending receipt of full payment.
2. Shipment of all orders shall be at the expense and at the risk of the purchaser. We undertake to exercise every care in assembling and packing of orders. Claims for shortages or damage will only be considered if submitted within eight days of receipt of the shipment quoting the invoice number and customer reference number. Under Austrian consumer protection legislation (para. 5e KSchG) private consumers have the right to withdraw from a contract of sale within seven working days after receipt of the goods. In this case, the goods must be returned to Helbling undamaged and at the consumer's expense.
3. Unless otherwise stipulated all invoices are to be settled in full within 14 days of the date of the invoice. In the event of failure to make payment by the due date, the purchaser agrees to pay all reminder charges and collection costs. Private customers have the right to return goods purchased within 14 days after receipt. To comply with this condition it shall be sufficient to post a notice of withdrawal from the contract or to dispatch the returned goods within the 14 day period.
4. All consignments remain the property of Helbling Verlagsgesellschaft m.b.H. until such time as we have received full payment.
5. Goods are supplied under the regulations governing the book trade laid down by the Austrian Association of Publishers and Booksellers. In countries in which resale price maintenance applies to books and related products, this shall be recognised by the trader, who shall undertake to comply with the fixed resale price as established under the trading and sales regulations of the Austrian Association of Publishers and Booksellers. In particular, the trader shall undertake not to sell goods supplied by Helbling at a price lower than the specified resale price. He shall further undertake not to supply such goods to resellers without contractually binding such resellers to comply with this condition.

6. Goods shipped with a right of return will only be accepted by Helbling if they are returned within the agreed period and in pristine condition. Returned items for which no right of return has been agreed can only be accepted if authorisation is requested and agreed prior to the return.

7. All sales contracts concluded by Helbling are governed and construed in accordance with Austrian law. Helbling and the purchaser agree that exclusive jurisdiction over all matters arising in connection with transactions under these terms and conditions shall lie with the court in Hall in Tirol, Austria.
